Terms of Service

1. Acceptance of terms

By installing or using SeraVault CloudSync ("CloudSync", "the app", "the software"), you agree to these Terms of Service ("Terms"). If you do not agree, do not install or use the app. These Terms apply to both the free tier and paid subscription.

2. Description of service

CloudSync is a Linux desktop application that synchronizes files between your local machine and third-party cloud storage providers (Google Drive, Dropbox, Microsoft OneDrive, Amazon S3, Backblaze B2, and Cloudflare R2). SeraVault provides the application software; the cloud storage itself is provided by the respective third-party services under their own terms.

3. Subscription and payment

• Free tier — CloudSync is free to use with one connected cloud provider and one sync folder. No payment or account is required.
• Subscriber tier — a paid subscription ($9.99/year) removes all limits on providers and sync folders. Subscriptions are billed annually through Stripe.
• Cancellation — you may cancel your subscription at any time. The app will continue to work with subscriber features until the end of your current billing period, after which it reverts to the free tier limits.
• Refunds — refund requests within 14 days of purchase will be honored. Contact cloudsync@seravault.com.
• Price changes — we will provide at least 30 days notice before changing subscription pricing.

4. License

Subject to these Terms, SeraVault grants you a personal, non-exclusive, non-transferable license to install and use CloudSync on devices you own or control. You may not sublicense, sell, resell, transfer, distribute, or otherwise make the software available to third parties.

5. Acceptable use

You agree not to use CloudSync to:

• Sync, store, or distribute content that is illegal under applicable law
• Circumvent, disable, or interfere with security features of the app or any connected cloud service
• Reverse engineer, decompile, or disassemble the application except to the extent permitted by applicable law
• Use the app in any manner that could damage, disable, or impair SeraVault's services

6. Third-party services

CloudSync connects to third-party cloud storage providers. Your use of those services is governed by their respective terms and privacy policies. SeraVault is not responsible for the availability, reliability, or policies of any third-party service.

7. Your data and files

You retain full ownership of all files you sync using CloudSync. SeraVault does not access, store, or claim any rights over the content of your files. You are solely responsible for ensuring you have the right to sync any content you configure the app to handle.

8. Disclaimer of warranties

CloudSync is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. SeraVault does not warrant that the app will be uninterrupted, error-free, or free of harmful components.

Important: CloudSync is a sync tool — incorrect configuration can result in files being overwritten or deleted on your local machine or in your cloud storage. Always maintain independent backups of important data.

9. Limitation of liability

To the fullest extent permitted by law, SeraVault shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or business interruption, arising out of or related to your use of or inability to use CloudSync, even if SeraVault has been advised of the possibility of such damages. SeraVault's total liability for any claim arising under these Terms shall not exceed the amount you paid for the app in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold SeraVault harmless from any claims, damages, losses, and expenses (including reasonable attorney's fees) arising out of your violation of these Terms or your use of CloudSync.

11. Modifications to the service

SeraVault reserves the right to modify, suspend, or discontinue CloudSync at any time. We will provide reasonable notice of material changes. If you have an active paid subscription at the time of discontinuation, we will provide a pro-rated refund.

12. Changes to these terms

We may update these Terms from time to time. Updated Terms will be posted at this URL with a revised effective date. Continued use of CloudSync after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Louisiana, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Louisiana.
